References for informed consent

I am attempting to have it so that our IV team can consent for PICC line placement.  I have seen the Informed Consent standard from INS, but I am wondering if there are any precedents that I can site or data that I can use to convince our legal department.  Any data would be helpful.

Our PICC nurses obtain their own consents and do the informed consent discussion with the patient/family.  This is supported by our Legal Department since we are the ones doing the procedure.

Consent

I believe it depends on your state and the definition of informed consent.  A few years ago we had to change our practice and the physicians now have to get consent after explaining the risks, benefits, and alternatives.  I was informed by my legal department that as a nurse in California I am not authorized to obtain informed consent.  I still go over everything with my patient and document the education.

I think CA is the only state

I think CA is the only state with such a strict law about informed consent. But this process is primarily about patient education anyway, so you can't go wrong with more education! Lynn

informed consent for bedside picc insertions by a picc certified

In the state of Pa. nurses are not permitted to obtain informed consent for procedures. So the ordering physician needs to obtain the consent. The verbage in the consent states that a nurse will be performing the procedure at bedside, complications, reasons for the picc vs other type of central catheter etc.
